These Terms of Service ("Terms") govern your access to and use of SchlappyOps, a web-based job and client management tool ("Service"), operated by SchlappyTools LLC, a limited liability company ("Company", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and capable of forming a binding contract to use this Service. By using SchlappyOps, you represent that you meet these requirements. The Service is intended for use by businesses and individuals for lawful commercial or personal scheduling purposes only.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@schlappyops.com if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.
SchlappyOps offers a free tier limited to 5 jobs and 3 clients. Upgrading to Pro ($19/month) removes these limits. Subscription fees are billed monthly in advance and are non-refundable except where required by applicable law. You may cancel your subscription at any time; your Pro access will remain active through the end of the current billing period and will not auto-renew. Pricing is subject to change with 30 days' notice.

You retain ownership of all data you input into the Service (your clients, jobs, and related records). By using the Service, you grant SchlappyTools LLC a limited license to store and process that data solely to provide the Service to you. We do not sell your data. We may use aggregated, anonymized usage data to improve the Service.
The Service, including its design, code, branding, and underlying software, is owned by SchlappyTools LLC and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of the Service to you. You may not copy, reproduce, or create derivative works from any part of the Service.
The Service integrates with third-party providers including Stripe (payment processing), Resend (email), Supabase (data storage), and Google Maps (address autocomplete). Your use of these integrations is subject to those providers' own terms and privacy policies. SchlappyTools LLC is not responsible for the availability or conduct of third-party services.
Beta Software. SchlappyOps is currently offered as a beta product. As such, the Service may contain bugs, errors, or other issues that could result in data loss, service interruptions, or other unexpected behavior. SchlappyTools LLC makes no representations that the beta Service will meet your requirements or that it will be suitable for use in a production environment. You use the beta Service at your own risk and should maintain independent backups of any critical data.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, SCHLAPPYTOOLS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless SchlappyTools LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising under or related to these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in North Carolina. You waive any right to a jury trial or participation in a class action lawsuit.
We reserve the right to update these Terms at any time. We will provide at least 14 days' notice of material changes by email or by a prominent notice within the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
We may suspend or terminate your account at any time if we believe you have violated these Terms, without liability to you. You may terminate your account at any time from your Account Settings. Upon termination, your right to use the Service ceases immediately. We may retain anonymized or aggregated data after termination.
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
